1. Agreement to Terms

By creating an account, accessing, or using WebTechDetector (the "Service") provided by WebTechDetector Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. This is a legally binding enterprise agreement. If you do not agree, you must immediately cease all use of our platform, services, and APIs.

2. Nature of Data & Intelligence Gathering

WebTechDetector is an enterprise-grade intelligence platform. We utilize proprietary data aggregation methods and advanced algorithms to analyze publicly accessible web signals, internet metadata, and global infrastructure footprints.

• Our systems operate strictly passively; we do not perform intrusive penetration testing or exploit vulnerabilities.
• We do not access authenticated, private, or restricted areas of any web property.
• You acknowledge that technology profiling results are inferred from public footprints, and while we employ industry-leading models, we make no absolute guarantees of accuracy or completeness.

3. Acceptable Use and Restrictions

Your license to use the Service is strictly conditioned on compliance with the following rules. You agree that you will NOT:

• Reverse-engineer, decompile, or attempt to extract the source code or proprietary methodology of our detection engines.
• Use our platform, bulk processing tools, or APIs to facilitate malicious network activity, targeted harassment, or cyber-attacks.
• Automate the creation of accounts or attempt to bypass our infrastructure rate limits using rotating proxies or unapproved scraping tools.
• Resell, redistribute, or white-label the data acquired from WebTechDetector without an explicit Enterprise licensing agreement.

Violation of these rules will result in immediate, permanent account termination without a refund, and we reserve the right to pursue full legal remedies.

4. Payments, Cancellations, and Refunds

Access to our premium intelligence, bulk processing tools, and enterprise APIs requires a paid subscription. By providing a payment method, you authorize our certified payment processors to charge your account on a recurring basis (monthly or annually) until you cancel.

• No Refunds (All Sales Final): Because the Service provides immediate access to proprietary digital intelligence and downloadable B2B data that cannot be returned, all payments are strictly non-refundable. We do not offer prorated refunds for partially used subscription periods.
• Cancellations: You may cancel your active subscription at any time via your billing dashboard. Cancellation will take effect at the end of your current paid billing cycle, allowing you to retain access until the cycle concludes.
• The Zero-Usage Exception: WebTechDetector Inc. may, at its sole discretion, grant a refund only if it is requested within 24 hours of the initial purchase AND the user has registered strictly zero usage (e.g., no API requests made, no bulk scans executed, no data exported).
• Chargebacks: Initiating a fraudulent chargeback or payment dispute through your bank or credit card provider will result in the immediate, permanent suspension of your account across our global network.

5. B2B Data and Compliance

The intelligence provided by WebTechDetector is intended strictly for Business-to-Business (B2B) applications. If you utilize our data for corporate outreach, marketing, or lead generation, you agree that you are solely responsible for complying with all applicable global regulations, including but not limited to the CAN-SPAM Act (USA), GDPR (Europe), and CASL (Canada). WebTechDetector Inc. accepts no liability for legal penalties incurred by your external campaigns.

6. Limitation of Liability and Indemnification

The Service is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, WebTechDetector Inc., its executive officers, and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages, including lost profits, loss of data, or business interruption, resulting from the use or inability to use the Service. You agree to indemnify and hold our organization harmless from any claims, damages, or legal fees arising from your use of the platform.

7. Modifications to the Agreement

Our legal team reserves the right to modify these Terms at any time to reflect changes in our enterprise offerings or regulatory requirements. We will notify active users of material changes. Your continued use of the platform after updates are published constitutes your binding acceptance of the revised Terms.
